TM trademark or circle c appears on every major name. As at the bottom of this page.

That's how everyone knows. Without it how would i knwo what is or is not a legal TM or copyright?

When anyone says to you "howling at the moon," what do you picture? It's an iconic image engraved in everyones memory. :angel:

You're supposed to assume that all items created after 1978 are copyrighted unless you investigate and find it's not.

I think people are confusing some of the issues here. There two different things being talked about, copyright and trademark. Copyright applies to a body of work that represents the idea of the person who created it. This applies to music, book or magazine article. If the user wants to protect the body of work, he/she must use the c with circle around it with a year that was first published. According to US Patent and Trademark office, the copyright is defined as

"A Copyright is a form of protection provided to the authors of “original works of authorship” including literary, dramatic, musical, artistic, and certain other intellectual works, both published and unpublished."

Trademark is a symbol or a tagline that company wants to protect as it's brand identification. There are two parts. Anyone can use the logo or tagline with the TM at the end if he/she wants to protect it. This establishes the trademark so if there is a dispute, first to publish has the right. If you register with US patent/trademark office, then you need to use a r with a circle around it, indicating that it's a registered trademark. If you go to USPTO.org, you can find more information.

Let's get real technical.

Did you take the picture with your camera of the moon in the background? Or did you get it off the internet or out of a book? Was it in public domain or did you steal it from someone else's site or publication?

It matters. If you do not or did not get permission to use the photo of the moon someone that actually owns the right to that picture can sue you for that.

Now do you really want to cause a fuss about someone else that has a similar, not exact or even close picture, similar to your logo?

That's all i'm going to say about it. :angel:
