I have a private party booked and they asked me if I could record the singer doing their number and give them a CD. Is this legal? Does anyone do this? |

I believe it's legal. Read some of the older posts and you will find information on how some of the KJs do the recording. I haven't experimented with it yet, but I know of KJs that do and use them as filler music. As far as giving the customers CDs, I know of KJs that sell them and some that give them away. That's all I know about it. |

Technically it's illegal without express permission from the publishers of each individual song. |

There is no need to complicate things by bringing legal issue into a simple private event. As long as no one makes money out of it and it is for private use, you will not be drag to court. |

One reproduction of recording does not require fees of any kind. I know this is hard for anybody to believe. All I can say is enquire to the proper parties to pay fees. They will tell you the same thing. It in no way does it constitute distribution or redistribution and proving financial losses in any court civil or federal would be futile. |

I have a Singing Machine Karaoke player with a color camera, and I have a DVD burner. This provides the capability to record the singer on video. I would do it for free, just to attract business. I would only ask that the singer bring their own DVD+RW disc for their recording. No money moves. |

So long as its NOT FOR COMMERCIAL USE and ONLY FOR PERSONAL USE then it should fall under FAIR USE which allows to make ONE COPY ONLY for PERSONAL USE ONLY(ie listen to it in the car or on your OWN mp3 etc). Any commercial usage of the DUPLICATED MUSIC requires licsence from the publisher. So this person would have to determine if they are doing a COMMERCIAL USE. It sounds like they are---as this is in the context of a PAID GIG. Must remember the DIFFERENCE between PERSONAL and COMMERCIAL use. Its not the same as A PUBLIC OR PRIVATE gig. If theres money making occuring that involves the duplication of the music(as a "SERVICE" which this would be) then it is no longer PERSONAL USE. So just because you are have the TECHNICAL MEANS, EQUIPMENT, ETC to do recording/duplication/reproduction doesnt mean you have the legal permission or liscenses from the COPYRIGHT HOLDERS/PUBLISHERS to do so. Your decision. Do as you will......but just beware. |

The recordist can go into a professional studio and pay any amount for the recording. As long as he doesnt make a cd and sell it or give it away, there is no copyright infraction. This is personal use. In public the only fees are public performance which the venue is resposonible for. |
