JimHarrington wrote: No, because we aren't licensing anything we don't own or have pass-through licensing for. Once a publisher becomes a part of our program, they participate in the royalty pool in exchange for permission. If they don't want to participate, they can enforce against the operators directly. Say what? "aren't licensing anything we don't own?" Really? "pass-through licensing".... so that's your twisted "ownership" carrot.... PEP-Tone Entertainment: "Oh, yes, we've been collecting revenue on these songs that we didn't even make a disc for, and if you want a piece of this pie -- made from the songs you wrote and were stolen -- just agree to "license us" collect for you... And if you own 100% of the copyright, you'll get 1/16,500th of what we collect.... So if we have 10,000 kj's signed up, we'll collect $24,000,000 per year and after administration fees, we'll send you a check every quarter for $37.50 for every song you have. It's like free money falling out of the sky! We do all the work and you can't lose!"It's an accounting trick, pure and simple.

I doubt that any of the rest of us have been actively engaging in your fetish of sniffing Calvin, but feel free to "smell the rainbow" if it floats your boat. I knew it!, I just knew it!... Somebody owes me $10....

audioprola wrote: I paid for my Pre sale disc. Does anyone know when production will begin. Thanks I've been asking whether or not production will begin, deadline extended or refunds to be processed.... JimHarrington -- the company's lead attorney for suing venues, KJ's and it's spokesperson and marketing manager -- has simply ignored and evaded the question entirely. It was their deadline of Oct. 1st to sign up.... Their agreement allows them to extend that deadline 30 days or send out refunds.... He's simply refusing to give those possible (and prospective) customers and update... So we'll sit and wait for his answer..... (maybe when he comes down from the summit with the info carved into a couple of stone tablets)

Mr. Harrington has not yet posted any new updates in here regarding the (possible) release or (possible) refund.

For anyone who may not be familiar with the proposed idea, here it is from their own agreement: Quote: 7. UNDERSALE. In the event that fewer than 320 reservations are made, paid-up, and not canceled during the subscription registration period, Phoenix may in its discretion (a) cancel the Program and issue a prompt refund to every subscriber, (b) waive the minimum-sale requirement and proceed to production as though the minimum-sale requirement had been met, or (c) extend the Registration Close Date by not more than 30 days. Refunds will be made to the payment method used to purchase the subscription. Going on day 3 with nary a peep from the people holding your money....

Since you're not a customer or a prospective customer, you have no interest in my answer, and I have no interest in answering you. Your interest is in casting aspersions and in attempting to embarrass us in order to feed your unhealthy obsession.
For actual customers and prospective customers: We will announce on Monday what our plan is for moving forward. I am expecting publisher sign-off on a list of possible tracks next week. If you have already signed up, you'll get an email about it, and we'll post an update on our site.

Nice to see that even after all this time, I still have enough power over your actions (i.e. "living in YOUR head rent-free") that keeps you from making any announcement publicly about the contractual agreement that you entered into with every single person that has sent in their hard-earned money. And, I don't have to try to embarrass you... you do that fine on your own regularly. But the customers that sent you money aren't important are they? They're just KJ's and you'd rather not make your announcement simply because I'm pushing you.... when you are already late. Priceless! Let us know on Monday if you're going to either go ahead with production (not yet), extend the time (most likely), or refund (slim-to-no-chance) any money... I also find it disingenuous for you to claim you have "a list of songs" when you've apparently not shared what that list is to your OWN "customers." Very priceless... Keep whatever secrets you want... you KNOW I'll find out anyway....

Jim, i think a good way to begin to repair the image and garner a bit more support especially from those who may just be on the fence because of the past promises, would be transparency. you stated regular updates and song lists of what is being voted on, neither has happened. just letting people know how many reservations have been made (a ticker on the PEP website, i'm not talking necessarily specifically on this forum) so everyone can see the progress, and a list of the top 20 voted songs so far (obviously with the disclaimer that it is pending approval from the publisher) could go a long way. if people saw that you were close and saw what their song choices were, you may get more on board and if not, it could quiet the drone. one of the biggest things that you get beat up about is the silent cloak and dagger method of everything involved with SC. do SOMETHING in the open ESPECIALLY when you are asking for money.... open the blinds to let some light in and suddenly it's not so scary anymore, unless there really is something in the room that is exactly what you thought it was when it was dark.

We will be making an announcement on Monday. There is a lot more going on right now than just this program.

English translation: "No. We will do what we want - when we want to do it."Great job of swatting Paradigm's helpful suggestions aside. This is what PEP is about though; Even their own customers can tell them what they want and they poop on them for doing so. And this is the way you treat a "certified KJ?" Shameful. (must have graduated the "Latshaw School of Customer Service.") PEP-Tone already has your money... they'll take their sweet time now.

Were you formerly a member of Animotion?
I haven't brushed off anything. If you were an actual customer, you'd know that we bend over backward to be accommodating to our customers. The fact that you can't be patient means nothing to me.
I can't release a number today because we haven't finished vetting all of the reservations. More than fifty percent came in in the last 48 hours. I also can't release the initial prospective song list because I have to get publisher sign-off. All in good time.

You "brushed off" everything and everyone.... not just Paradigm, but your own customers. Yeah, there's definitely some "bending over" going on and it ain't backwards, just ask your customers how it currently feels for them. Not to mention that YOU set the deadline - not the customers that sent in their money - YOU hold their money, YOU promised a list and YOU missed the deadline. And now, you're still not doing anything but lip-service.... the same kind you've been spouting for 6 years... "vetting the reservations" is most likely a fabrication or at the minimum a pretty crappy excuse.... actually it's a very crappy excuse because that's all it is: an excuse. (But you'd like to make it sound like you're having a last-minute victory - yeah right.) And you can't give a list because you haven't "publisher sign-off?" Once again, you and Kurt shoving what YOU think KJ's want... their opinions/suggestions/desires obviously don't matter at all - you'll give them what you want to give them and they should just pick from your list and be grateful right? Keep on backpedaling though, the dance you do is amusing... I just feel sorry for the customers that have sent in their money and you're right; I'm not a customer and you're not holding any of my money.... so feel free to take all the time you like.... This show isn't costing me dime..... (time for more popcorn)
