This Place has this in their FAQ...... Quote: Are music downloads from BuyKaraokeDownloads.com legal? All the music downloads you purchase from BuyKaraokeDownloads.com are legal, so long as you comply with our Terms of Use, including the End User License Agreement & Usage Rules. We only sell music that has been legally licensed for sale to the general public for personal use. Our songs are licensed thru HFA (Harry Fox Agency) for distribution to our customers for personal use and for DJ/KJ's use. The venues that play the songs must have license agreement thru ASCAP or your countries like organization to publicly play or broadcast the songs. Here is the link. In one place they list "" personal use"" and in another they say OK ""for DJ/KJ "" use. I have seen this so much and spent $$ on music I fear to use this raises red flags. Even All-star had posted on the Target site this kind of mixed messages. Call me overly cautious but would advise reading "End User License Agreement & Usage Rules" REALLY close and printing and keeping a copy (I've seen them change overnight too IE KV ) |

Basically From what I can Gather after reading several Legal Precedents is that Downloading MP3+g Files from a company and using them in a Single "Rig", is Legal. When a Company says "Not for commercial use" they are talking about Commercial Retail use (Eg. Buying their MP3+g's and burning them to CD for Open market Sale at a profit). Not Commercial Performance Use. The Reason I but a lot from karaokedownloads.com and Karaoke Trackz is because they mention specifically in their terms of use or FAQ the "Okie Doky" for KJ/DJ's to use the content they are selling. Karaoke Trackz is a UK based Company and karaokedownloads.com is a US company. |

as i understand, the difference between personal and commercial use in the terms of music is the PRS payments. unlike with a jukebox which most of the time the jukebox leasing company bundles the PRS fees in with your rent of the system, buykaraokedownloads.com or tricerasoft.com do not pat the PRS fees, that is up to the venue. |

very good info and a bunches to think about. I really want to be able to download and use MP+3's at my shows just VERY cautious. Re-purchaced the all stars tracks on plastic for safety sake. A very big thank you to everyone for discussing this without any drama.....that makes me do a Happy Dance |

You have your facts a bit off on jukeboxes. Jukeboxes are generally not leased except by individuals for private use such as parties. Jukeboxes are either owned by the using business or the location is provided by the business and the jukebox owner splits the money taken in. The owner of the jukebox pays all upkeep and licensing which when I was doing it in the 80's was $15 per machine. Should be pretty obvious. They carry no major US brands and when they do, they remove the start-up screen displaying the major US brand's logo. I have personally downloaded a couple of songs that I thought might have been different versions than what I already had but they looked suspiciously similar to the one's that I already had. I A/B'd the two versions and lo and behold they were identical with the exception of the start-up screen. I reported this to the manu of the song and they told me that they and the other manu's were aware of this and that they do have them in their cross-hairs. |

What law enforcement agency is enforcing that BarryTone? Or otherwise, what jurisdiction does that fall under? Federal. State, Local and how would it be policed? Total BS, I'll use them if I want to if I legally have paid for them. |

CB may have something top say about the SGB tracks they are distributing. And I bet if they removed the logo's or changed the logos they might get in trouble as well. |

Well Rick Good . . . I wasn't advising anyone as to whether or not they should use these tracks. I was only commenting on the legality of them. If you are confident in your legal understanding as to what a copyright infringement is then by all means go ahead and use them as you see fit. However judging by your questions regarding which law enforcement agency is responsible for enforcing tort law or under whose jurisdiction this would fall under then if I were you I just might want to reconsider my position in that regard. |

I actually notified the usual three, and they all told me they were aware of the situation. The track I downloaded was an older Karaoke Monthly rock track. I never downloaded a BKD track but I did see them come up at one of the shows I attended, and thought they sounded pretty good to me. I tried to locate the manu that produced the BKD discs but couldn't find anything on them. Finally it dawned on me that, duh . . . BKD stands for BuyKaraokeDownloads. Pretty much explains why I couldn't find an address for them. Looks like they not only sell them but they make them too! Obviously they're either licensing the audio from the manus or they are ripping them off without their knowledge. I suspect that it is the former, but I have no evidence to support that notion. Just my opinion. |
