This one has it all: Twenty Four plus defendants, all related to the same multi-rig outfit. The usual Unauthorized Trademark display. The usual John Does yet to be determined. The usual Unfair Competition. A new player in the lawsuit game; Piracy Recovery, LLC (formerly Chartbuster) The new Trademark removal with a Trade Dress twist. Here's a thought.... I wonder what the settlement package will be now that Chartbuster is part of the suit? And now that Chartbuster is out-of-business, do they still have something to sell to keep a pirate in business? |

For clarification to those that do not know: The term "successor in interest "means a successor to another's interest in property, especially a successor in ownership of a business that is carried on and controlled substantially as it was before the transfer. in Lake Erie the Ohio Supreme Court stated that the term "successor in interest," as used in Ohio workers' compensation statutes and regulations, "is simply a transferee of a business in whole or in part." 578 N.E.2d at 460. SC jumped in, took the hits, made the alterations and improvements and set the stage. Notice that it is Mr. Harrington who is the lawyer on this one. I'm glad CB has been able to join but this isn't just their effort. |
