OK, we know that Digitrax owns the CB library in hopes of re-packaging and re-sale. We also now that PR obtained the old CB trademark for the purpose of income through litigation. Here's my question: How will the courts react to a company (PR) who has obtained the trademark from a defunct company for the sole purpose of litigation based income? On top of that, how would PR POSSIBLY prove damages to THEM through the use of that trademark? Certainly not loss of income- they don't sell anything.. Certainly not misrepresentation of a their product- they don't have one. What damages could they claim? I have a feeling that whoever arranged this may not have thought it through. Either that, or they are in the hopes that intimidation might be enough? I truly don't know.... |

I suspect it's something legal, as in I bought the company, I own the trademarks/copyrights, even though I don't still produce anything. And, I own the debts of the company too.. (If any) |

If you look at how things were going before CB went under, you can see that Digitrax already was a part of CB before they took it over. Don't you think that CBs announcement about "news that would shake up the karaoke world" must have been their plans with "The Cloud" etc? So Digitrax would have had an interest in the success of the company before they took it over. The fact that they haven't launched yet does not mean they don't sell anything or have plans to sell anything. In fact, aren't the tracks available as customs at karaoke.com CBs? If Digitrax has acquired full rights over the CB library then they have acquired the rights that go with it--including the right to protect it. They would have lost profits as former interest holders in CB and they would lose future sales due to the songs already being out there at no charge. At least those would be things to consider before jumping into the usual spin. |

LL, you are talking about digitrax and in that case you would be right, but they have the library, not the Chartbuster trademark. Joe was talking about Piracy Recovery LLC. who owns the CB trademark but not the music. the entire point of them buying the CB trademark was to do what they do..........sue. if i bought the SGB trademark, and you bought the SGB music library, i could sue for trademark infringement but you could not. at least i think thats how it would work...... |

Exactly. Digitrax isn't the company that will be suing, and they won't be protecting anything. It is Piracy Recovery that owns the old and defunct CB trademark. My question stands: What possible damages could they claim? As stated earlier, I believe they will be using intimidation through litigation- as SC has- without even a hint of a case that would hold up in court. Nice to see SC has created a model- thoroughly bogus as it may be- for others to use as an income producer. My only hope is that Karaoke Hosts spend a bit more time educating themselves as a shield to these tactics. |
