For once i agree with you completely Ollie. It seems many posts at this forum perpetuates a kind of paranoia that's hard to shake sometimes. Nobody wants to get into legal trouble for anything, so that fear comes through.

I personally look for facts, as one should imho- but some seem to be happy trading their opinions for someone elses, then displaying it proudly. When they are corrected by the wise ones here via FACTS, it's funny as they scramble to find the real logic in their belief and support it with sound references.

But as stated YES we are in America- and shouldn't be threatened by the paranoia that our small industry could create. We all know the laws will change eventually, the enforcement for those blurry laws haven't been enforced except in one or two cases, and we should enjoy doing our jobs and making a decent living off of it while it still exists. I will join you in the compound Ollie if it gets too CRAZY out there! LMAO

Which leads to a fact-finding question. Has anyone EVER been prosecuted for recording singers- with or without video, and had to pay fines?

This sounds like fun,  when I mix these days I have one concern only, and that's frequency sensitivity I've lost in extreme ranges.  Same concern with accompaniment work, balance. I tend to crank up bass too high because I've lost some of the bass range and try to EQ mids and highs to compensate for minor hearing loss but also to replicate the warmth of "mids rising" which gives tube warmth the nice tone, I just can't do it although I try.  While I too like to play around with mix, I think I missed the boat in terms of having the hearing response needed that might enable me to mix for others in a different digital age (compared to the analog turn nobs and hear stuff more clearly younger days). I just have lost enough sensitivity to make this a tough thing to do, mix and EQ conventionally well,  Now if I was serious about concerns regarding legality, I'd have a consult with my Atty in REAL LIFE, and leave this ongoing diatribe out've the board for reasons that it can't and won't resolve in these venues. Additionally many pontificating laws in type, are no angel in real..  Seems the "legality" debate only accomplishes one thing and that's diatribe.

So back to the topic,  Sounds like a fun thing to do guys.  I wish I had the skill to work soundboards, not easy.. Especially with frequency loss.  

I'd be more interested in knowing what starting such an operation entails in terms of capital.  Do you go to a bar and record there ?  Or must you have your own vehicle that's prepared and setup to record ?  Equipment,  type vehicle, insulation panels ?  speakers ? type battery ?  Mobile recording requires a whole vehicle setup doesn't it ?   I know nothing about this.. what do you need to do this stuff up front ?  Do you think it'd pay itself off these days ?  Do you just use a digital recorder and travel to noisy venues or does a vehicle need to be set and soundproofed and stuff mixed down, etc as with a recording studio ?

Are you allowed to walk in to a concert with a camera and start recording?  They will toss you in a minute.   You have no permission to do so.   And it's illegal to do so.

I'd suggest you go to a concert in a large venue - I went to Heart just recently, everybody had dig cameras and high quality dig cameras take pretty good video. I also went to Evanescence recently - same thing. They've given up now on keeping cameras out of the venues, at least at the concerts I've gone to (large venues in Seattle). Oh, Gretchen Wilson last summer - same thing. Everybody is taking pics and shooting video. It all shows up on YouTube the next day, too...impossible to prosecute the number of people who are doing it.... but that's another losing battle.

There have been many videos removed from the youtubes and others.  Why?   Because they don't want sued.  They probably got a letter from a lawyer telling them to cease and desist.   Post your videos and you could get your very own letter.
Ignore it and pay the price.
