Did anyone else see this? It was just on and I was trying to listen as I was getting ready for work. From what I picked up:

A male KJ picks up a female partner. But shortly thereafter he splits them up so they can work two rooms. In her room she can use his equipment for $25 a night (!) and gets to keep everything else. The verbal agreement is that she isn't to work the room completely on her own, since it was his contact.

A couple of months later she emails him telling him to pick his stuff up as she no longer needs it. And she's no longer paying him. When he gets to his equipment some of it's trashed.

Judge Judy said:

Because he wasn't paying her taxes she was an independent contractor and not obligated to anything. Plus there was nothing written down. Too bad about your equipment, guy.

He also showed evidence that she was using his stuff on nights that she hadn't been paying him. He pulled her calender off her Myspace page. She cried "invasion of privacy!" Judge Judy didn't buy that, but once again since there was nothing written down she wasn't going to order restitution.

Just a few more reasons I'm glad to be on my own. And nothing against you husband-wife teams because that's different.

And I gotta get to work.

good to know if you need the help of an independent contractor....
however.... Judge Judy usually makes complete sense to me and I don't see in how in this case the absence of anything in writing has a bearing on the woman being responsible for keeping the equipment in reasonable good shape?

I watched it and Judge Judy said that had he proof that the equipment was in perfect condition before she allegiadly trashed it then she would have entertained the equipment end of the suit. As to the theft of the customer, nothing was in writing that she had to wait two years before talking to the client so that there wasn't anything to do about it considering he didn't have a witniss to say that the verbal contract was what transpired. Just tells you if you are going to do what he did, get pictures of the equipment before it goes out and get everything in writing.

Thank you for posting this as I found it real interesting. I agreed to let my ex-husband use my old system so he can make some extra money. I don't worry about the no compete clause contract as he lives in a different city from me but now I plan on taking updated pictures of the whole system.

ps......Judge Judy is a beeeyatch.....she doesn't use the law, she uses her opinion most of the time......just my honest opinion..... :)

Believe it or not that system was bought with him and I bought a whole new system 2 years ago and the old system has been sitting at our son's pace. No biggie.

Sorry but engaged to my high school sweetheart Timothy.

As for Judge JudyI like her and usually agree with her.

OK... Playing Devil's Advocate here.... What good will pictures of your equipment do? Assuming that the equipment looks like it is in the same condition before and after leasing it out, a picture wouldn't show proof that I blew out one of your speakers. I could just as easily say that the speaker was like that when I got it. Same holds true for the rest of your system.

As for getting everything in writing, that should ALWAYS be common sense when you are doing anything in business.
