So I was at a show last night and the host had the new 3500s. They do include a disclaimer at the end that states anyone playing the disc from a harddrive is liable up to $750 per song. Lame.

I can't say for 100% certain that I have 100% of the discs for which I have songs on my computer. Please. I can say I've got most of them, but let's say I play a 3500, someone calls SC ('cause they didn't get to sing the last song), rep comes in to audit (slim chance, I know), and they find I'm missing say 7 discs out of my collection. 7x15x750 would be enough for me to throw in the towel.

Sure, easy answer is, well then take 'em out. Blah, Blah. I just think it's lame that they'd go to that length. No different than the littering hot-line. Gee, I'm po'd at my ex, so I'll just call the litter hot-line so she gets a letter. Do that a couple of times, and she'll get a ticket in the mail. It's anonymous to be a tattletale.


Anyway, I wanted to comment on this US Karaoke Alliance. Are these alliances jokes? I noticed that the head guy is a entertainment company owner (DJ/KJ). Maybe I'll start calling my shows National Allied Karaoke Singers' Conventions.

I assume this is all he and his wife do, and I can understand those that do this for a living not appreciating the undercuts out there. But it seems like he's selling more advertising than crackdown. Search Engine Placement, Web Services, etc. He's an advisory member of the KIAA (what have they done in the last year?)?? If 80-90% of the KJs/DJs out there are running with some illegal material (by definition), how do they expect to raise enough dough to sweep the nation. Couple of KJs here, couple of DJs there can't do squat.

Until the manus and the courts come to an agreement, nothing will change. The 8 letters that SC sent to the KJs in the AZ area (where USKA guy is from) serve what purpose? Personally, I think these Alliances are no more money making schemes.

Just opinion.

The idea that a KJ will actually end up in court over format shifting is hightly unlikely.

First of all, the cost involved in bring such action is astounding... and if they lose (a very real possibility as the supreme court has already rule in other music cases in regards to advancement in technology... that copyright laws can not impede tech advances).

Expecting someone to carry around a case of discs instead of a laptop clearly violates the logic of the supreme court's previous ruling!

This whole discussion is absolutely ridiculous! The chances of a legal format-shifted host getting nailed for anything is pretty well zip zero nada. Come on - dozens of pirates multirigging dozens of shows, NEVER getting caught. Geesh. I'd sure as heck plea bargain with them if they found even ONE song on my system that I didn't own hard copy for - Hey, I'll trade you - 3 guys with 100,000 songs each, nary a hard copy in sight, for my one song...howzat sound to ya? Maybe a format shifter needs to set precedent and the rest of us can breathe easy but fact is until these harddrive pirates are nailed, I'm going to go on my merry way and not worry one iota.

Umm... I'm a KJ, I am exempt from fees, the bar pays the fees. I play the music. 8)

I think the point that was made was, no one can come in and start going through your harddrive song by song for "pirate" songs without a supeona... and the idea that that would happen is a little outside the realm of reality... which is why this is a stupid conversation. The legal fees for doing that and the labor involved would bankrupt any music orgaization that tried to do it on even a small scale.

Buy your disks, and your bar pays its fees then you've got nothing to worry about. Get a grip on yourselves! :roll:

koyote, the statement was made by karyoker. I know it's the responsibility of the venue. He made it sound that because the bars are American they don't have to pay fees or some such nonsense. It just seems to be his response to things he doesn't like.

lmao, this is just one of the things Obama has appologised for.....Tim, don't always take that expession that way......it's just an expression....most people don't use it thinking through how this might sound to a non-US citizen....not to mention, Tim, you are an American too......something few think about when they use the term "American".

TIM I haves year had direct dealings with ASCAP for years. Ask any member of the AMOA. The general consensus is they are totally out control and have too much clout. And yes the M word is always used to describe thier power and tactics.

Second post - Lets get a grip - There are US citizens walking the street with their kids because they lost their homes because of the economy andno where to live, the news is full of Obama swatting a fly and the aspca is up in arms, NORTH KOREA has nuclear war heads pointed our direction and all you can all talk about is to you have legal or non legal karaoke - this is a joke!

well, since this IS a karaoke site, chances are pretty strong we're going to discuss things that PERTAIN to karaoke. The whole illegal issue of format shifting and still having your discs VS those that refused to do computer VS the bootleggers that don't have or can't prove purchased tracks (people who buy a loaded hard drive) is VERY much on our minds. Because we don't like the idea of a manufacturer threatening us with lawsuits or legal action.

Exactly. Butsie there folk on here that karaoke is their religion and they are KARAOKE SAINTS and argue constantly about their rituals and rules. And by gawd that it the only way and if you dont adhere to their standards then you are trash.

Sometimes they are worse than the Jehovahs Witnesses trying to jam .their rules down your throat and tell you how to live or run your business. I GET BALLISTIC.... I do not need their legal rumors or legal advice. I have been in many professions and yes this is a joke. I run a professional business and dont worry about the flybynighters or pirates.

Simply not true, you give up nothing... Posession is 9/10 of the law. There's a neat little thing called the constitution in the U.S., you should read it. There's a clause in there about "unreasonable search and seizure of property."

Its why the cops can't search your car without reasonable cause. They need to get a warrent to do so even with.

For a private entity to take possession of your personal property (my computer) they would first have to bring some sort of causable action against you and then file for a supeona to gather evidence to prove their action.

Some guy comes up to you and a bar and demands to look at your harddrive, you tell him to show you a supeona or get bent... and if he touches it have him arrested for theft. Plain and simple. :roll:
