Well this lawsuit didn't happen overnight. This was YEARS in the making. There is a very good reason they have worded things the way they have about the music publishers. I trust their lawyers have studied the implications of all this MUCH MORE than any of us, and they see the potential loop holes and opportunties as well the the current litigation climate. They also know how the music publishers are thinking and the direction they may go in the future.
If you read between the lines, I think I'm picking up a vibe that they feel the hammer is going to drop on laptops and hard drives eventually. They want to make sure they are not party to that when it happens.
So, I will continue to use discs.....and I think bars will be looking for disc toters like me........

They are enforcing laws that are in the books and have been proven in courts. They do not have the authority to walk into a bar and question the legalities concerning hard drives. Federal busts consist of many man hours spent in initial investigations, They dont go busting like Wyatt Earps. Law enforcement agencies have a hard time figuring out how to pay for tires on their patrol cars I am sure they want to tie up an officer in a federal case which would involve weeks of time better spent in enforcing laws with a higher priority.
In my professions I have had direct dealings with the FCC, OSHA and the FBI. I know how they operate. I also know what my rights are and how to conduct myself as a professional business man. I do not get legal advise from the internet but act in a totally professional business manner. I dislike those who question my integrity and make false accusations and hide behind an avatar. I will stand up and tell you put it where the sun doesnt shine. I hide from nobody and rest upon my reputation and morals which were handed down for many generations. My word is good as gold and I will give you an honest hour of services for an honest just payment.
Is the generation gap so wide now that some here do not understand what I stand for? If it is then this nation is hurting. Believe me and get this straight... When I stand I represent all the struggling artists and singers who do it for the pure pleasure and dont prostitute their talents. I have promoted karaoke for many years and tried to put it in first class entertainment instead of the rap we get daily.

I have news for garth brooks If they are not singing your songs in thousands of karaoke bars then you are a hasbeen. You have insulted and forsaken a large part of your market.

No one day it is legal to CREATE his music for karaoke, then the next day the manus can no longer. Once you bought it, it's fair game & as long as your club is paying the publishing fees, it's no problem playing them.

I get maybe 3 or 4 of his songs being sung anymore. Usually Friends In Low Places, Rodeo, Papa Loved Mama & The Dance. May be a couple other sporadically come up.

This was just one lawyer's opinion I came across on a website (I know, Karyoker, couldn't help but read it, though.) He guessed that if there ever was a case against transferring songs from CD&G to hardrive then there already was a precedent set when the music manufacturer's tried to make MP3 players illegal. They lost that case because as long as you weren't putting the song on MP3 to copy and sell it or redistribute it someohow you were just giving it "portability." It was ruled that it was fair use to give a song that you had bought "portability." i guess it would take a real case to see if it carried over but with no actual harm being done on a 1:1 basis, why would there ever be a case?
On the present case it appears that Sound Choice gave warnings first and the opportunity to pay for the music being used before they went to court. Now maybe the damages being asked were ridiculous--I don't know--but it looks like the ones being taken to court either couldn't or wouldn't pay. It will be interesting to find out the details--but also disconcerting that out of 10 clubs, they believed 8 had illegal music.
Karyoker, I could see opposing govt. oppresion by making moonshine (but not selling stuff that would make people go blind) or growing a bit of pot illegally for home consumption--but copying a disc so you don't have to pay for the work put into making it seems different somehow. And I know the whole ASCAP/BMI thing is slanted against small musicians and its getting out of hand but shouldn't there be some recourse if someone uses someone's product without paying for it? That being said, why don't they just get on with it and make downloads legal? Or I guess they are working toward it finally. But it's pretty silly that you would be forced to use a CD&G yet not have anything very reliable left to play it on. (we are still disc-based but not against computer.)

Just had to order a used Sound Choice Garth Brooks from amazon marketplace to cover the Garth Brooks on the second rig. Still being sung a couple of times a night here in TX!

since I dont produce or reproduce cd's I do not distribute or make a profit selling cd's I do not detract from the profit form the folks I buy cd's from. it's a second generation copyright that you don't have the right to do under commercial use. You do under personal (i.e. FAIR USE).

The point you're making is what whe all make when we've gone computer. And SC agrees with us. The point is moot... right now, if someone were to question what we're doing, that's the first thing I'll do is point them to the direction of Zoom and SC and say "I've asked them about converting to computer, and they say they don't care as long as we're not distributing them or using mulitple copies at the same time."

But, Sound Choice has 4000 additional karaoke song files in their library for sale via an Austrailian website that they cannot sell in the USA without violating USA copyright laws. You can legally buy the file from the website, but, it is illegal to use it in the USA without being considered a pirate. They or anyone connected with them will not reply to any questions pertaining to this.
All this hoopla from SC about piracy and sueing to make sure a KJ is 100% legal seems to be quite a stretch considering their own marketing tactics.

The CDGs bought from Sound Choice Australia were and are perfectly legal. Part of moving the Custom product to Australia was due to the deal with Stingray, part of it was due to the arcane laws in the USA. If I buy a legal disc from Australia and import it, I can play it. The disk is licensed and as long as the venue is paying BMI ASCAP SESAC then all is good.
Most new SC disks were produced in the UK for this same reason, doing the run around the US laws. They are legally importing and distributing a UK product made in accordance with UK laws.

This is the whole point right here. It doesn't matter where the music was purchased beit over seas or down the street in my local MalWart. The clubs paying their publishing fees, it's fine.

I didn't know they made them here. I wonder why they didn't sell them in the UK in that case, I don't know of a single retailer here who sells SC discs.
