Who cares if he liked your LAY OUT and "verbiage" and used it himself?
You posted it for people to LOOK AT IT and be impressed.....you may be flattered that he liked it so much he tailored his own to be similiar?
Personally the more I look at them...the less they look similiar
STOLE is a big word and from what I know about Cabaret Karaoke (Ollie) ---he doesn't seem the kind to STEAL anything ... maybe you just owe him an PUBLIC apology and let it go.
But thats just my $.02

Lonman @ Fri Aug 21, 2009 2:05 am wrote: Which photos are the same, I saw nothing of the same pics. As far as the layout, yes I saw that. But as stated it was already stated that he wanted to use your layout. Lonnie, in addition to the spinning stars, scroll down and you'll see 4 images: one that says "Most Popular" and 3 smaller icons: a mic, a singer and a spotlight. Right click on them and look at the Properties. Then tell me where those images are hosted. PartyHits.com is also my site. (Regardless whether Karyoker knew that was my site, he did know it was not HIS site - and linking images from other sites is a big no-no.)
I probably wouldn't have even known about it had he not been using my bandwidth for the images.
As for the fact because I didn't reply that I was tacitly giving permission? As Dr. Phil might say, "That dog doesn't hunt." In absence of a reply in the thread, I can be asked my permission via PM, email, even my phone number appears on my site. Maybe I'll ask a friend who is not in the room if I can use his car. Since he's not there, I'll assume it's OK. Want to bet when he reports it stolen and the cops find me with it that I get arrested?
Jamkaraoke, it's more than just "similar". Much of the same verbiage is being used.
Since I make a substantial part of my living from writing for the web, it is MY "intellectual property". The same as if a singer came to me with his disc to play and I ripped it for my own collection. Taking my words and images without my express permission - whether you like the word or not - is STEALING.
Truth is, I probably would have said OK if I had been asked. The issue here is express permission was not secured from me prior to its use.

BTW Dan, did Tommy Shaw give you the rights to his intellectual property for your tagline?

But thanks for playing!
Karyoker, as long as you host the images yourself, I give you permission to use my verbiage as amended. Good luck!

You guys should let Judge Judy settle it. We would benefit from the entertainment and y'all would get a free trip to Cali.

Dan is the one who took the time to think up the presentation of the layout, come up with the categories and create the words. He came up with HIS idea for a marketing campaign and someone else just had to modify it a bit to use it. So I can see how he would be miffed. But I don't think Karyoker meant it more as flattery than harm and it looks like they are going to work it out amicably.

Dan,
What are you after here? Are you offended that he borrowed some of your ideas, or that he's linking to images off your site, or both? Do you think your business has been hurt in anyway, or just your feelings? How many singers from CO do you think he's taken from your shows?
He's proposed changes, and it doesn't sound like he cares one way or the other. Perhaps you should begin your litigation now ... Although, I trust a reasonable judge would rule with the 'what difference does it make' principle in mind.

I sort of understand where Dan is coming from ..but on the other hand you could look at 100 other kj/dj sites and they all look similiar.
I think it could of been handled in a more PRIVATE fashion and settled without attempting to discredit Cabaret Karoke. I'm sure no malice was intended and would have been corrected without much hassle.
But then again it makes for an interesting topic

No Harm No Foul. I'm still modifying but here are the changes. I really thought I had taken care of the bandwidth issue and did take liberties thinking it's only a craigs ad. I was in the process of modifying but got sidetracked.

Dan,
What is your motive in posting this thread, when this matter can be effectively handle via other means?

Hey Ollie, I do recall an episode were she ruled against the DJ. Something about the record kept skipping and the DJ said it was because of people dancing or ....somethin' like that. Anyway the the DJ lost.

If someone wants to copy something on my site, I really really really don't care? If it would harm me or my business in someway, yes. Again, that's just me.
