I guess it is in how you interpret it. I read it as saying you can't record/duplicate any Priddis track. An exception being if you want to make a demo track in your own home, you may. However, if you make money on the recordings, if you are even GIVING these recordings away for free would be considered unauthorized distribution - this is in the "additionally" part of the paragraph.

Sales and distribution of any product containing our music without obtaining proper licensing is strictly prohibited.

I'd contact the company that you are trying to record & find out from the horses mouth & not from something that can be read into several different ways.

LON & Others I'm sure If ya call Priddis and discuss your intentions BEFORE recording such tracks and clearly state such intentions.. I'm sure you will find them very easy to deal with. probably more easier to deal with than let's say... "the other guys". To this date I have not had a problem with Priddis.

I find everybody at Priddis Music very accomodating, no matter what the situation may be. :D 8)

I don't record karaoke singers or release tracks for money.
Just my own showcase tracks for here. 8)
Everything I Record & Release for pay is Original.

Yeah, I am sure everyone already knows this, but for those that doesn't. Priddis differs from the "other guys" in this aspect. Priddis started out as a company doing "performance" tracks. Like for Ms.World competitions, for people doing local musical events etc when you can not afford a live band.
You can buy their karaoke CD, sing a song in the park for charity, or cash for your own pocket if you like, this is what Priddis was created for. Priddis are not as rigid as the "other guys" when it comes to making backup copies for their karaoke CDs either, they clearly say that you can.,since you bought the CD and own it.

Cerial,
As you stated I just got off the phone with one manufacturer, it wasn't that hard to aquire permission to record a song for showcase only. NOT FOR DISTRUBUTION, DEMO OR RELEASE OF OTHER THAN IN THE KARAOKE SHOWCASE. Like I stated earlier. If you state your intentions clearly & honestly with most any manufacturer, ya just might get lucky. It's always good to check first.

To answer your question, have you done it for money?

No

Have I done it?

Yes, occaisionaly for good customers, as a thankyou.

Is it legal?

That has been hashed over here before.

One other point to think about; The difference between COPYWRITE and LICENSING.

The manufactures have to get a license from the copywrtie holder in order to produce CD-G's. Most karaoke manufactures donot copywrite every song. Therefore if the karaoke CD-G is not copywrited then the copywrite violation is with the orginal copywrite holder. I'm not inferring that it is ok to copy a CD-G.

Personally, I don't have a problem with recording a song, without the graphics for noncomercial use.

I contacted Sound Choice on this very issue about a year ago. Sound Choice will sell you limited rights to do recording of singers at your shows for a reasonable fee. If I remember correctly, I was told $150.00/qtr. Of course, if you run more than one brand of disc you're gonna have to talk to each manufacturer....and if Sound Choice offers a song on a disc that they later pull because they don't really own the rights to the song, I'm not sure how protected you are legally.

Personally, I wouldn't worry too much about it because I think there are bigger fish to fry than single op KJs....but that doesn't mean you're legally safe. I have recorded a few times, as a favor, but it's a lot of extra work. If I was going to do it regularly, I would have to hire someone to help me which would pretty much negate any profit margin. But if your show is bigger or if you have lots of singers that will pay to hear themselves, it might make money for you.

Since it's been asked... I did some checking on the sound choice web site and here's what they say:

Can I use your karaoke media for my recording booth at the back of my store. My customers want to make a quick demo of themselves and they are NOT buying the karaoke media.

If no purchase of the karaoke media is made then that media becomes a "master source" of which a master track fee should be paid. Retailer booth owner cannot use ONE CDG as a master for multiple copies. We do have a MASTER TRACK LICENSE program for booth operators though - any other variation is ILLEGAL

and

Can I use your karaoke media for my recording booth at the back of my store. My customers want to make a quick demo of themselves and they are buying the karaoke media.

Yes, as long as there is a one-to-one ratio of a karaoke media sold for every recording made.

and even

I have some of your tapes and want to use it for an album. I want to make multiple copies of this recording and I plan on selling it. Do I owe anything?

Yes. This is a commercial use. Permission must be granted and mechanical royalties are paid directly to the publisher at what is called the Statutory Rate (it is currently .0695 cents per song per copy). You must pay a master track fee for the use of each Sound Choice song. ($150.00 per song)

All information located http://www.soundchoice.com/faq/3.shtml.

and answered in their forum here:

Other manufacturers will vary on how they handle this specifically, but this is what SC has to say about it. I looked on the Priddis site and didn't see anything right away about it, but I'm new to thier site so I may have missed it.
