While looking over Chartbuster's new and improved website I found the following which makes me a little upset as I own a lot of their discs.

Question:
Can I back up my discs?

Answer:
You are allowed to make a single copy of your Chartbuster Karaoke discs for archive purposes only. Please note that this does not entitle you to use those backed-up tracks for any other purpose than as a back-up, including playing, sharing, distribution or performance.

Karaoke shows that use tracks stored to a hard disk drive are doing so in violation of the Chartbuster Karaoke license printed on the original disc. Unless the tracks were purchased as digital downloads and are being played from the original disk onto which they were downloaded, the operator is in violation of the license.

So why make a back up if you can never use it?

Question:
Can I move my Chartbuster Karaoke tracks between storage devices?

Answer:
The original compact disc on which you purchased your Chartbuster Karaoke tracks is the only licensed copy you may use for karaoke purposes. Therefore, while you may choose to migrate your backed-up tracks between devices in order to accommodate changing technology, the original copy is the only one which may be used for karaoke. If your original disc should become damaged, stolen or lost, we have a specially-priced program specifically to replace the original for you.

The sole exception to this when you purchase Chartbuster Karaoke tracks as digital downloads. You may not make archive copies of these tracks at all, for any purpose. Your original digital copy is the only licensed copy that may be used for karaoke purposes.

Again why bother

Question:
Are hard drives loaded with Chartbuster songs legal?

Answer:
Chartbuster Karaoke allows the original purchaser to make a single backup of their tracks for archive purposes only. Selling, playing, or performing with tracks loaded onto a hard disk drive is in violation of the original license, unless those tracks were purchased as digital downloads and are on the drive to which they were originally saved.

If you believe that a business or individual is selling or using Chartbuster Karaoke tracks in this manner, you may report them by visiting www.IllegalKaraoke.com and inputting the relevant information (you can report violations anonymously).

So I'm taking it that Chartbuster is saying "YOU CAN NOT PLAY THEIR STUFF OFF A COMPUTER!"

What I can't understand is that they say it is legal if you use their digital downloads as long as you use the original hard drive that you downloaded the song to.

I'm suppose that makes any of us that have CB on their hard drives illegal.

This is pretty much the same stance that SC and Steller have had and still do have, SC isn't saying or has ever said it was legal for you to put move thier music to a hard drive, just the opposite, they have the same licensing stipulations as CB, they have continually said they cannot support a hard drive format due to thier original licensing aggreements, All Sc has agreed to do is not sue you themselves if you have paid content, 1:1 ratio, kurt sleep has been very carefull in not saying it was legal, same with stellar, the maufactures know very well they can't legally give you permission, so they are just agreeing not to sue, still leaves original license holder free to go after anyone they want, should they ever decide to do so

I have heard or read zero messages from Sound Choice where they have said it was legal to format shift their product just that they would look the other way for those whose ratio of songs on the hard drive matches 1:1 with discs owned. You own the disc the song was from then you have zero worries. If you don't have the disc then you are in hot water.

Not exactly a MESSAGE, but a LEGAL DOCUMENT from their legal reps.

Even if they dont have the right to say it is legal, in my book they cant sue customers once they authorize them to format shift as long as they keep the discs as archives. If some other rights holder has a problem with the format shift, they reserve their right to take action.

but I do find it funny that SC contradicts their own legal documents, if a case ever gets into court such contradictions can be interesting.

They say they won't come after you if you are 1:1 but they could still sue to make you prove you are 1:1. The Safe Harbor is a way to show you are 1:1 to avoid being sued.

"Sound Choice's CDs are pressed and printed, just like CDs of regular music you would buy in a store. If your CD is not original, it is not legal."

Except of course for the new stuff (and newer copies of older discs) which come in the Sound Choice 'green packaging' plastic sleeves, are burned discs with heavier printing on the label side. - Much like some of the Chartbuster stuff.

There are certain fair use rights that you have. These rights are not ours to either grant or deny. One of those rights is to make archive copies, or to format-shift. Likewise, we cannot grant you rights to use those archive copies. These rights are not ours to either grant or deny.

Glad to see you here... Could you explain the SCDG discs. Did CAVS publish them or did Chartbuster? Since I know alot of Karaoke hosts have format shifited SCDG's does the CAVS Chartbuster karaoke music fall under CAVS or Chartbuster.
