My hard drive with my karaoke has bit the dust. I have decided for now to import my smaller library onto the new drive and then wait for Sound Choice to come out with their GEM series (MP3+G discs) partly because If asked for prove all I would have to do is produce less than 200 discs and a piece of paper that provides my license for the GEM series. No big deal as the discs are in a 208 disc pouch. I figure what do I have to worry about as long as I have the discs and the license for the GEM series. No Big Deal. I would answer them before they got to the actual filing to keep my name out of the papers.

Help me out here guys.
In the back of my mind I have a feeling it was mentioned that with permission
(or working as an agent for) it may happen that way.
OK, that feeling could just be dry rot. (Yes thank you guys)
But...
What would happen if that were or were to become the case.

Sorry, but they file first and THEN notify you, so it doesn't work that way. If they actually approached the KJs in question BEFORE filing and asked them if they had the original discs, I would feel less animosity to what they're doing. However, they're not.
Their method is sue first and get the facts later.
Not cool.

They may have permission of sorts from the other manufacturers and may be working with them, however, unless the other manufacturers signed documents assigning their legal rights to SC (which will never happen), they DON'T have any LEGAL right to do it. It would not hold any water in court.
A judge would ask SC "What rights do you have to these songs"? They would have to answer, "none", and the judge would say,"Next!'.
Only the legal owners of the copyrights, trademarks, or what-have-you can bring an action in court.
So, no, they don't have any RIGHT to do it, unless of course, I let them. Which I won't.

No you are completely wrong on that. They send a letter of intent to file first then if you don't respond they file. We are only reading about the idiots, if they are legal, that did not respond to such a letter.
And another misconception that is out there is that Sound Choice may not have the right to audit other companies discs on their own, They have the Permission by Pop Hits and Chartbusters to do so and forward their findings to the other companies.
They DON'T have the right to sue on the other manu's behalf. That is Pop Hits Monthly and Chartbuster's right to do so.

And IF that's the case, then what about them trying to get you to sign their document before they'll do an audit? Either way, the whole thing stinks.
Too many things wrong with it for it to be of any real value to anyone but SC. But then, that's what they want. Just don't expect me to want the same thing.

Another misconception that has propagated on this board is that you need to sign your life away for an audit. My friend on another board who has been through the audit did not have to sign anything.
If you are 1:1 you have nothing to fear from an audit. As soon as I am done loading my drive, I am going to join the KIAA as well as submit to the audit. Granted, I only have 12 Sound Choice discs to begin with but am not going to eliminate them because of a chicken little complex.

File the suit against the KJ (and club) #2. Send a letter of "intent to serve" to the KJ. No doubt along with the "audit contract." If you fail to respond to this letter then, #3. Serve you with the suit. (nothing becomes "real" until the suit is actually served - period) DannyG2006 @ Tue Jun 15, 2010 6:07 pm wrote: And another misconception that is out there is that Sound Choice may not have the right to audit other companies discs on their own, They have the Permission by Pop Hits and Chartbusters to do so and forward their findings to the other companies. Again, it's simply semantics vs the law; SC might have "permission" from others to look, but unless they are actually a party to the suit, it means nothing legally to the KJ and in my opinion, they are under no legal obligation to show them anymore than SC. They could claim that they have "permission" to check your freezer to make sure that it has R-134 refrigerant and not freon instead from that manufacturer too.... but that won't go anywhere either.

If you've only got 12 discs now, then deleting them won't really make or break your shows will it? It won't matter if you keep them or lose them.
I just tried going to the website for KIAA.... on two different computers.... neither one would load more than the title page, ALL other links were dead including those in the site map. If I was WOS, I'd probably say; "Gee, I wonder what they're hiding?"

Yeah, whatever.
By the way WOS, what happened to your pretty KIAA avatar? Certainly much more impressive than a pic of 50 or so discs... If I was going to speculate.... I'd have to say that it would be my opinion that perhaps they asked you to stop using it so you wouldn't mislead other forum members into thinking you were actually associated with them in some official capacity...
Just thinkin'.....

HI C. Stanley, A freind on another board said you had invited me over to tell of my experiances... should we start another thread and I can answer all questions about receiving my letter of intent and my audit process?

Yes requested an audit right away.... WE had nothing to hide and were 1-1 compliant...we signed nothing but agreed to future audits...admitted no guilt and were removed from SC suit...joining KIAA as soon as site is up
