Actually it's working out quite well. One pirates book went from 50,000 to like 2,000 overnight out of fear of a lawsuit. He wouldn't have enough money to comply anyway because he only works for booze & tips! Looks like he had enough tips to buy a Sound Choice Foundation set that sits next to his computer, I guess that's compliant enough!
Wow Chip, criticizing me about having 2 systems with only enough jobs for 1? That coming from a guy who went from 7 digital sound systems to 1 since June 3rd 2009? I know the economy has sucked in Michigan for some time but I didn't realize that last year Farmington was hit so hard! I have dispatched out Michael Moore to interview you for his new movie, "The Slep's & Me". I look forward to seeing it....

Here's another insinuation on your part..... but that would be expected from "the Spin King" or a much better description would be "Twisty the Clown." But the fact of the matter at hand is that you have a pretty hefty investment that is simply gathering dust. I'd say 50% of your investment sits idle when you could at least be working for booze 'n tips or charging SOMETHING if the current booze 'n tips guy was gone. Especially with that huge investment in those highly-prized and coveted SC songs that singers the world over can't live without.
In a nutshell, what you're saying then is that even you... the "great and powerful wall of sound, inc., KIAA Membership #002144" is unable to get any new gigs from all this legal action (including your working so closely with private investigators) that would possibly put your investment to work.... Shame really. All that money on SC discs, microphones, songbooks, mixer, television and stand, speakers, cables, stands and for the most part, just gathering dust... And for what? So that "boozy the karaoke guy" could get a Foundation set at a discount price and continue with his sterling entertainment that even you can't take away with your vastly superior library? tsk, tsk...
So you're living proof that SC is NOT out to stop piracy but sell them discs and keep them in business that the legit operators can't touch.
Yeah, Michigan's economy is pretty bad....
We're not like Nevada...
We only have a handful of casino's and NO legal prostitution.

It is the semantics game... Some dont consider an "intent to file" notice to be a lawsuit, but it to some(me) it is a step in the lawsuit process. Yes you were sued.

I think it's more of a misnomer; it shouldn't be "intent to file" because it's already been filed, it should be instead; "intent to SERVE" because like you said; "yes, you were sued."
I would be interested in whether kjathena had an attorney involved or just handled it themselves.

KJathena claims on another forum that she consulted an attorney and that attorney advised her to request an audit, audit concluded that she was compliant with SCs 1:1 guidelines.
My question would be, "did she have to agree to any future audits at SCs request?"

Manobear she did put on here just a few spaces up that yes she did agree to future audits. Signed her future rights away is what she did and signing up with KIAA is signing your rights away even more. I don't need anyone to audit me for me to know that I am legal.

On the "other" forum where Athena is from, there are several prolific posters who just can't resist taking digs at anyone who is critical of SC. And one such poster is the troll, Wall of Sound, who is enamored with everything that SC is doing and marches along in lock step with them!
To me it is a fact of life that are, basically, three types of people:
1) Those who kowtow, without questioning, to those with and/or in power
2) Those who are concerned about what those in power do with their power and now much power to they actually have and try to minimize their power
3) Those who are not sure about those who have power and how to react to said power.
Just this week, for example, I saw some footage on TV of a NC Congressman manhandling a young man who asked him a question on camera about his politics. Without responding to the man's question, the congressman demanded to know who the young man was (I guess that could be read as who he represented)? And when the young man refused to answer the Congressman the congressman became enraged and then further manhandle the fellow by grabbing him around the neck.
Those who think as Wall of Sound does would figure they "have nothing to hide" and start screaming I AM WALL OF SOUND, I AM ALSO INSANE KJ. LET ME TO LET ME TO, I HAVE NOTHING T HIDE. So folks like Wall of Sound/Insane KJ would wonder why the young man didn't simply provide the answer(s) demanded by the congressman. Wall of Sound would assert again that since he had nothing to hide why not just kowtow to the congressman and answer his "simple" question? Why not dispense with Miranda Rights as well?
Continuing along this line of reasoning, I am familiar with what Athena (and her husband) have posted regarding their audit experience. Most important is that they "pooh-pooh" the fact that their good name comes up as an accused pirate on any internet search. As Athena stated in one of her posts:

So they rationalize what they experienced based upon a false expectation that SC is successfully fighting piracy. Athena hadn't thought about what the impact would have been on the audit if she had used the same catalog number in each library for the same disc!

I guess she could have held up all 3 discs with the same catologue number in front of the web cam simultaneously?

Yes we did meet with an attny...and were advised to request the audit.
Yes we do have seprate systems and each disc was marked with a #ing system to find them before we "went" digital.
If they had not been marked then we would have had to show all three copies
Yes we did agree to future audits...we have no problem with that we are legal.
As of today 5 people I KNOW to be pirates have dissappeard from our area. I realize it will take sometime to "retrain" the venues to decent rates but it is working.
I wil advise agian if you are legal you have nothing to worry about request an audit...if not get legal.
BTW rumor has it Stellar is working our area now.

Thank you KJAthena for posting your experiences. I am in the process of separating my discs into distinct libraries to match up with how they are separated on the two rigs HDD. Obviously I do not have 2 identical rigs. Here's my kicker... on the nights when I am running only one show I combine the HDD to have ALL songs available. If you come to my Thursday show you may get to sing a song that you can't sing the following night at the same venue.
Of course if I could still buy all the older SC (and other manu) stuff that has gone out of print then I would. Until then there will always be the occasional disappointment for some singers.

Yes We do not have any trouble agreeing to future audits even after showing we are 1-1 now.... If you are legal it is no big deal. When I lived in NC I had to have my car inspected every year. If you run a reseraunt here you are inspected quarterly. Each state inspects MANY businesses for quality and legality. We have chosen to join KIAA and abide by the rules.

Ok I get that you are happy with audits... It is no big deal to you, I get it.
I know the answer is in there, but I must clarify cuz it got lost in all your happiness towards future audits.
You were required to agree to submit to future audits in order for SC to drop the lawsuit. You did answer YES.
