Other issues aside, I see a continuation here of the misuse of the word "Legal". The same occurs regularly with the word "Pirate".

I'm no friend of SC's, but even I will tell you that they have NEVER said the use of downloads is illegal, nor have I.

SC may or may not believe that downloads are in compliance with their policies, but have not stated anything about legality. That is why T-soft asked for documentation of such a statement.

Legality based on the law as laid out by the government), is something completely different from compliance, which is merely the way any given party wants something to be. A law is enforceable by the government or it's agents as soon as it is signed into existance. Compliance is only enforceable by law if it can be proven that it's premise is the same as the law.

Of course, compliance ( say, in the case of a loan shark) might also be enforced through physical pain. In other cases, verbal and written intimidation based on scare tactics are also used. However, compliance itself ( no matter how attained) is nothing more than one or more parties agreeing to do what one or more other parties tell them to do.

It's like the word "Pirate" used in regard to those that SC has sued. SC is suing for Copyright Infringement. Technically, a KJ could have all pirated music ( by that I mean stolen, unpaid for music) with the EXCEPTION of having every disc for every SC track they own, and SC would have to drop the suit, leaving the KJ song thief free and clear. SC is merely suing media shifters, some of whom MAY be pirates, and some who are NOT.

Yes, I've heard the gossip of supposed label acquisitions in hopes of suing for other TMs, but it has never been verified.

My point is that if you are worried about SC's audit, it is SC who will tell you whether downloads fit their policies or not.

Of course, their answer may or may not be valid, as it will be biased toward them. However, if it is SC you are worried about, then I guess you wish to live by their rules, as laid out by them. That being the case, you have to ask THEM.

I was not sure of the intent and so I remained cordial. I was in hopes that you simply were pointing out the obvious "rules". But as is seen in the forums regularly, sometimes it is pointed out as if being reminded with a ruler on the back of the wrists.
I take no offence to your comments. I feel that what I passed along in my info may go a long way to helping others understand this very grey area. Cheers

you got one up oon me, my request to Sunfly got forwarded right to Tricerasoft and i got no response from Sunfly directly, but the Tricerasoft email that i posted (forgot where) said basically the same thing.
