If you aren't reporting income, then you are just as illegal IMO - whether just as a hobby or a full blown company (even if it's just a name). That's what they eventually nailed Al Capone on - simple tax evasion.

But seriously what business is it of SC to view financial records other than receipts. And if that's all they want to look at for KJ's submitting to a voluntary audit then I wouldn't think they would have an issue modifying the verbiage in the covenant not to sue.

Which is why I made the statement, a pirate kj is more than likely not going to have any financial records like that anyway - especially if they are being paid under the table to begin with. They want to make as much as they can for as little money out of pocket - hence why they stole the music to begin with (paying for the drive does not constitue paying for the music on it).

The one that gets me Lonnie is the change of venue to NC. Nobody in their right mind should sign off on that...

Jon They are based in NC, so they don't want any other State's laws to interfere with their cases. It makes sense for Slep-Tone. It could screw an out of state KJ, though. You wanna talk about unfair practices,

Smooth, I am not part of a big company. It's the owner, his wife, me and two other KJ's that work nights I don't want to work (two of our kids can DJ also, but we hardly ever have enough work for that). BUT this little business has been the sole income of my boss for over 30 years. To watch him struggle now angers me. Some of it is his own fault because he is too nice.. not raising his prices for lessons, lowering his prices for weddings.. but to have some 'freelance pirate' (I don't mean you if you plan on being legal...paying taxes etc.) come up and ruin the karaoke in our area also angers me. So now, I will jump through hoops to try to get it back at least close to the way it was not oh-so-long ago. I don't have a problem with SC seeing our books... it's all there as far as what we get paid for our gigs.. and no double booking on one library. As for receipts for SC, I have only the six from the most recent SC purchases.. our Foundation and Bricks along with a few odds n ends, were purchased well over 7 years ago.. we don't keep records forever. I do, however, have a problem with having to to to NC IF there were a problem.

I won't have SSI to worry about. My music purchases will be for one system, and quite a bit cheaper without buying SC. I only have to upkeep one system. Technically, I could go into an area and charge $150, undercut another guy while being totally legal. As for going to NC, I don't fly. I am not a big fan of long road trips, either, so I wouldn't sign off on that.

Just curious... 14 hours is quite a drive... but only a hour or two more than the length of California. Once was a day trip!!

I agree, I don't like driving long distances anymore. Drove to El Paso from here a few years back... was a really yucky trip! I'm in the far northern part of Cali... texas is about 23 hours. Hated it.

I remember when i drove down here from Long Island (when I left NY to move here), we drove from Long Island to a third of the way through VA the first day, from VA to Savannah, Georgia the second day, then to Nokomis, Florida the third day. I swore I would never do it again. I made that drive in a 1987 Dodge Ramcharger with no A/C, on Memorial Day weekend. Driving through Maryland was a trip, as we went through the 17 year swarm of Cicadas.

I drove back from El Paso alone in a 2005 Jeep wrangler, with no AC and NO sounds of any kind. Manual 5 speed, too big of tires on it.. which makes for a rough and difficult drive. The no stereo was the worst though... I sang every song I could remember the words to... at the top of my lungs... just to stay awake! There's a lot of desert between here and there.. boring to the bone! Give me a mountain drive in my IROC any day!

Jon Jon, I don't think they're really looking for receipts. I think they're looking for proof of income made from what they consider a breach. Any income made is theoretically attachable as damages. Now -- here's the hypothetical worst-case scenario -- You sign the agreement, lease the GEM, and are doing everything right. Suddenly, either by virtue of a competitor or perhaps a bumbling investigator, you are accused of breaching the contract and NOW your financial records, including all of your income, are fair game. And of course you have to defend yourself in North Carolina, because you've signed away diversity and are no longer entitled to have the case heard in Federal Court in your state. My advice is to read and think carefully, and always keep the worst-case scenario in mind. Nobody ever have a problem until they do. Expect the best, but plan for the worst.
