I would do so Lon, but after several emails back and forth about songs I finally asked that question and they stored talking to me. any time you ask if a song downloaded from karaoke channels sure is ok for commercial you get a response in hours sayin' absolutely not, ask that same question about those songs from karaoke locker and you will not get a no.....our any reply again. Add their inability to say no and the fact that it started 9 years ago and kept growing and that tells me they are just keeping quiet to not have to say yes. If you can get a response, please post, they won't answer me at all.
Yeah the uncertainty would keep me from using them as well, bought in good faith or not.
One of the clubs that was named in a SC suit here was using PCDJ & Karaoke Locker tracks - don't know if it was exclusive that that was all they were using or not, but they did advertise they could download tracks on demand through them. Now they own the GEM & no longer download from what I understand.

Two things. First I'd like to take the person who coined "The customer is always right" and shoot them. It is the most asinine saying going.

Sorry you feel that way. It was never meant to be taken as a graven in stone literal statement. It was meant to remind those of us in business that customer service comes first, and that to be successful, one should work as hard as possible to ensure customer satisfaction.

That is the KEY to any successful business. Any business person that doesn't believe that is more assinine than the original statement, because common sense and experience shows that only satisfied customers return.

I would also add that in terms of word-of-mouth advertising, 1 negative review does more damage than 10 positive reviews does good.

for clarity, it was Karaoke Channel that will not answer anymore if you ask about Karaoke Locker.
Karaoke Locker has no issues stating what they are authorized to do (like Tricerasoft) it is Karaoke Channel that will not say no.
if Karaoke Locker is not authorized to sell for commercial use, why would they not quickly respond with a "no" and be done with it?
they are also selling Music Factory which is being sold by Tricerasoft.

Karaoke Channel is sold on Select-A-Track, too.

Still too iffy for me, I don't want to download KC tracks from Karaoke Locker then have KC start saying, hey those were never authorized for public use.

They are recycled SC tracks. I will pass. I still want nothing to do with anything SC.

i understand your position on that and i will not argue it.
what i am arguing is that Karaoke Channel tracks from Karaoke Channel are not ok for commercial use, Select-A-Track purchased Karaoke Channel tracks are ok for commercial use, but PCDJ purchased Karaoke Channel tracks can not be ok for commercial use.

ok if purchased form one that has never shown proof, but not another?

general question, not aimed at anyone in particular.

...Taken from another thread:

MadMusicOne wrote:
....So what about the KJ's/Pirates that have altered the Graphic portions of their files by taking off the Manufacturer's Trademarks. I found a thread, in some forum, speaking about this happening. Are they going after them?

c. staley wrote:
I'm not sure... HarringtonLaw needs to place his opinion on this one....

But I'm also pretty sure it's not going to come down to any other graphic element (like typeface... or "look and feel") since these tracks can be purchased from other sources labeled as the "karaoke channel" as mp3+G files.... with the exact same typeface and sweeps, etc...

Harrington Law Wrote:
While we had heard rumors of that being done, we actually encountered it for the first time in our last round of investigations. To answer your question, if they have removed the logos but kept the other graphical elements, yes, we are very much pursuing the KJs who had that.

Those tracks may be available for purchase, but not for use in a commercial setting.

It is also important to recognize who owns what. Stingray Digital's ownership of the recordings does not extend to ownership of the trademarks or trade dress. SC continues to have the right to sue for infringement of those items, and we will exercise that right where necessary.

Does it really matter?? If you buy KC from Select-A-Track and a sound choice inspector comes in and sees it, you will have to prove that you got the song from S-A-T, and that THEY allow public use. Still a hassle.

almost, what he was talking about were older SC recordings. they sold the recordings to Stingray, but the SC logo and dress are still owned and enforcable by SC meaning that just because they no longer own the rights to the songs on SC1700 (guessing) that doesnt mean i can download SC1700 and not pay.
they do not own the rights to Stingray TM or trade dress.
it is interresting though, the only one we seem to be having a problem with is Stingray and ..............

They (SC) still retain ownership for the music and swipes they only sold the catalog to the songs and KC changed the logos to theirs, or so I have been led to believe.

...That's cool, my apologies. Just bouncing around and doing some reading here. Also debating if I really want to go through with a SC Audit or just sell my SC CDG's. It's a shame considering the money spent on them. But am cautious about signing my life away.

You should be cautious about something like that, but you also should be careful about listening to people who haven't been through the process and who have a particular agenda. I would suggest that you talk one-on-one to some people who have been audited about how it went, what their life is like after certification, and so forth. I think you'll find that it is pretty close to the opposite of "signing your life away."

So if you used Karaoke Channel tracks that you paid for in your commercial show, who would be investigating that you did that? Who would be prosecuting you for doing it? What would they prosecute you for? What jurisdiction would that fall under? Stingray sending out undercover agents like SC is? Haven't heard of that happening...

So they will happily include a text document with each track stating as much for each and every title, and protecting KJs that use them from any liability, right?
