Interesting reading... Slep-Tone’s Complaint must be dismissed as it relates to trademark infringement because the defendants have no obligation to inform Slep-Tone or receive permission from Slep-Tone to make a media and format shift. Here's the link: http://soundchoicelasvegaslawsuit.com/2012/10/I love this part: Any display of the Sound Choice mark was a nominative fair use and is non-actionable

That link caused my anti-vius to detect a threat. Now do you have a link to the actual case rather than an infected site?

I've been to that website before and that hasn't happened.

Those blogger sites normally have "Pop Up Ads" to pay for the site..
Running an ad blocker works wonders.
(Perhaps the ad was infected)

It flagged a warning: “possible virus threat detection”. Close the warning, close the link, then click the link again & you’re good to go. The warning will not show up again. I get that red flag all the time, which I consider another ploy reminding me that my anti-virus is active, but if I buy & download the upgraded version ................. Other than that, no problem on my side.

I had no problem getting to that site and even though it was quite a long read; it was well worth the time. It seems that Sound Choice has lost a precedent setting case when it comes to their LOGO which should put a very quick end to all of the witch hunting; and just in time for Halloween. incidental use of the logo seems to be covered under the fair use laws.
Time for the pirates to break out the rum and time for the people who paid for the GEM series and their certificates of authenticity to cry in their beer.

Not quite Bruce. That is a suggested response to their lawsuit only, but it does give the Court something to chew on.

ok. my bad then. I thought that this motion might have been what caused Sound Choice to fail to pursue their law suits in Vegas which could now be used as a do-it-yourself kit for other KJs being sued by the big bad wolf.

I didn't have an issue going to the site using chrome. It will be interesting to see how these filings go.

I had no issues going to the site and this was interesting reading. No wonder harringtonlaw backed off those suits, this is a sharp legal mind on the opposing side it looks like.

No problems here either but then I'm using ad blocker.
What I found interesting is that whoever wrote that did it in such a way that anyone that has found themselves in a law suit can use it and from what I have seen is telling those that have been to use it!
It looks like the person that wrote it did a lot of research on the subject wrote up the paperwork only to give it away for free!
Will be interesting to see JH's response to this!

I can certainly understand where he believe that you backed off of the suit; specifically because there appears to be absolutely no movement, and no successes on the part of sound choice. Of course, once again it appears to be nothing more than "attorneys failing to do their jobs" which is apparently causing lawsuit after lawsuit to be dismissed. The question is really, if you are suing all of these KJ's for piracy then why pray tell, are so many of them successfully being dismissed? You can blame it on the attorneys, you can blame it on the clerk, you can blame it on the judge, you can even blame it on the sun being in your eyes. But ultimately it appears as though your case is far weaker than you would lead us to believe. and that simply makes your statement of "helping the industry" nothing more than empty words.

What do you think "movement" and "successes" would look like at this point in the LV case? c. staley wrote: Of course, once again it appears to be nothing more than "attorneys failing to do their jobs" which is apparently causing lawsuit after lawsuit to be dismissed. You have no way of assessing how strong or weak our case is just by looking at the docket.

HarringtonLaw wrote: What do you think "movement" and "successes" would look like at this point in the LV case? Well, when it comes to "helping the industry," I would expect that there would be more than we've seen so far. Lots more. HarringtonLaw wrote: c. staley wrote: Of course, once again it appears to be nothing more than "attorneys failing to do their jobs" which is apparently causing lawsuit after lawsuit to be dismissed. What on earth are you talking about? Wasn't SC's California attorney replaced by you? And pray tell why? HarringtonLaw wrote: We asked for a number of apparently unserved defendants to be dismissed in the LV case. We were unable to determine whether they had been served or not because they were being served by the investigator we fired, and he declined to complete return of service documents. Really? I simply find it unfathomable to believe that an investigator – who gets paid at the completion of their work – would go through all the trouble to actually drive out and serve these people only to turn around and "refuse" to complete a simple piece of paper to send to you. Once again, it's "someone else's fault"... (I think I'd fire the person that keeps hiring such incompetent nincompoops.) HarringtonLaw wrote: We're in discovery, Chip. You have no way of assessing how strong or weak our case is just by looking at the docket. And since you apparently have no evidence without discovery after the fact, neither do you.
