???? I don't know...some will buy legitimate licensed downloads....some will go back to buying discs...some will look for a way to buy unlicensed downloads using "alternative methods" ...and some will just keep stealing ???? Same S**t Different Day.

If your library is licensed and approved for KJ use, then why would your venue need to pay public performance fees?

On a side note, I would also like to point out that the recent changes in licensing in the UK are not a ban on the use of their tracks in the USA. The change in their compulsory licensing only omits distribution rights in the USA. It does not restrict any UK manufacturer from acquiring those rights the same way a USA manufacturer would. In fact most of the catalog of the UK manufacturers was licensed prior to the changes and are licensed for worldwide distribution just like the Sound Choice Gem set.

And when I went to their Custom CDG section, here's one thing I found under their Terms and Conditions:

3. Shipping:

Select the correct shipping. If you do not select the correct shipping, your disc will NOT be shipped. USA and Canada are together, UK is separate, and anything outside of USA, Canada, and UK must select Other.


To me, that sounds like they are OK with making sales to the US and Canada. I did not see anything mentioned about Custom CDGs that states anything about Personal, Home, or Commercial Use.

Okay... now lets talk about this, as the thread has degraded into stupid, i'm afraid to say.

When you purchase Karaoke music and use that in your show, that still does not cover the FEE for a 'public performance' of that music. THAT's the reason the bar needs to pay the ASCAP and BMI fees.

Now, your use of karaoke music is NOT a commercial use of that product as there is no retained performance for profit. i.e., you are not recording your performances and selling them. That is what is meant by 'commercial use'.

For example, if you wanted to use a karaoke recorded track to promote your personal performance of that track, you would need to contact the maker of the track and retain a separate license for that use.

I hope that clears everything up.

and in the terms and conditions:

2. Backup to digital media is ONLY allowed for storage as long as it remains in the possession of the owner of the license receipt(s) holder. Backup is the sole responsibility of the customer and you agree that TriceraSoft is NOT liable or responsible for any damage, corruption, or restoration of content that may be caused by choice of backup.

tricerasoft is the owner now.... and it's the exact same layout, just a different color as the tricerasoft download site.

Yes.....BUT, as SELECTKARAOKE.COM, and with a whole different purchase structure! You have to actually buy CREDITS, which translate into lower prices per song the more credits you buy. You all can read the details, but here is something to chew on as a possible accommodation for the morphing international situation: Could it be that this new structure classifies it, say, as a "subscription" service now, since you are pre-purchasing "credit packages"? And if this is so, does it somehow legally fit under current regulations in this realm?

I guess with all the heat that Digitop/Selectatrack is getting they figured why not get some return on all the Google ads they ran in the US and set up a deal with Tricerasoft? It's a win/win for them both... Selectatrack is only referring customers they cultivated in a market they weren't supposed to be in... and Tricersaoft got a new affiliate to send them loads of traffic for a site they are already using....

A quick look at the content and number of songs by each manufacturer confirms my suspicions :)

I only started paying attention to Select-A-Track because of the "sky is falling" rhetoric that was generated, so I don't know about Tricerasoft...has the Tricerasoft site always offered their tracks via CREDITS purchase, as the selectkaraoke.com does now???
