I haven't stolen anything. Your accusation is false. I USED to share music files years ago. I haven't done that in 10 years. Sorry, Tim, iTunes and I are very good friends. So are Tricerasoft and I, All Star and I and a few others.

My CD collection alone has been growing since 1991. I have DRAWS Filled with store bought CDs. If you BOTHERED reading that post, yes there was a reference to Led Zeppelin, but I have BOTH box sets, and all their live CDs, BUT I also mentioned concerts that are not available for sale. That's right, I used to download bootleg concerts. That is stuff NOBODY owns because it was never released. AND, I only used them for my own entertainment. What part of "printed on the label" don't you understand?

They don't mention ANYTHING about what IS authorized, and do not mention any definiton of what ISN'T authorized,. They also do NOT mention what entity or entities are capable of authorization.

Example: SC NOW says- after the fact and after the sales- that they don't allow any copies at all (which completely negates a previously published statement by Kurt saying that backups were OK by him).. Unfortunately what they want or don't want is of ZERO importance, because U.S. LAW states that single site backups are perfectly legal, which supercedes SC's wishful thinking.

SC made the GEM series and part of the sales speil was pushing the fact that they were made for ease of transfer to PC. HOWEVER, media shifting is still a gray area, and even SC is not allowed ( and they admit it) to give permission to copy from disc to PC. More ambiguity.

So in regard to unauthorized/authorized: WHO says so, and what are the opposing circumstances?

Well I'll tell you what, in regard to medical care, I'll take the capitalist trying to make money on new and better care over putting my life in the hands of the lowest bidder anytime.

Then don't ever get into a plane or car, most of the parts made on those were by the lowest bidder as well.
John Glenn made the comment on one of the first Gemini missions when asked what he was feeling about being the first into space, his response - "How do you think you'd feel if you knew you were on top of two million parts built by the lowest bidder in a government contract?" .

Joe what makes you think that the "Authorized Copy" "Rights Reserved" has to be written on every disc? Like I said, it doesn't need to be written. I don't remember any sign in any bank saying "Robbery is illegal" so because it's not written at a branch, does it make it legal to rob it? No. In fact someone, according to your "It's not written on the disc" excuse, can commit any crime and say he or she didn't know because it wasn't written in the area or read the penal code. Sorry Joe, ignorance of the law is no excuse.

It would have been Mercury. John Glenn never flew a Gemini mission. After flying atop the Atlas in Friendship 7, his only other space mission was on Discovery (STS-95) in October 1998.

Timberlea, if you actually READ my posts instead of skimming, you would see that "ignorance of the law" has nothing to do with my point.

THE LAW says I am authorized to make backup copies for single site use- therefore it is authorized BY LAW.

SC says THEY don't authorize it, and print ambiguous statements on their labels in order to hopefully confuse the end user into buying another original as a backup rather than making a LEGAL backup of their own.

THE LAW supercedes SC's wishes.

Nothing there is based on "ignorance of the law". THE LAW is what is to be followed.

I could run my entire show off of my backups (all clearly marked as such on plain white labels, BTW) and save wear and tear on my originals- and there is nothing that SC can do about it.

The ONLY reason that I use my originals is that it looks cooler and more professional on my work space.

To be fair, I also try to buy originals as backups if I can for the same reason- more professional to look at- and in the case of DK 1-99, not a bad investment for resale. However, the law saysI don't HAVE to do that.

Keep in mind that I am referencing U.S. law. Canadian laws may be different.

BTW- Do you know that I eat Nova Scotia with my bagels every Sunday? :mrgreen:

So Joe what section of the Copyright Act says you can make a copy for commercial purposes? You can copy for personal purposes but where does it say you can for commercial purposes?

Well now Tim, you are going to have to define commerial purposes- since NO KARAOKE PRODUCER SELLS DISCS LICENSED FOR THAT.

We KJs survive because the owners/publishers have shown no interest in bothering us.

SO- backups for single site use were made legal by U.S. courts in the software wars of the '90s. This includes movies, software, audio discs, and anything else for whatever use they were meant to be put to. ( Keep in mind that these backups are supposed to be media to SAME MEDIA, so media SHIFTING is still a gray area).

The question is, what is the intended usage? Well, the publisher/owner could go after us for using ORIGINALS in a show.

However, since the producers- such as SC- have never defined usage and CANNOT license commercial usage, backups of those discs are completely legal for whatever purpose SC intended. The PRODUCERS ( not owner/publisher) can't do a damn thing about backups.
