That's an awfully specific allegation.

Of course, there is almost nothing in this post that is accurate. Tony Macaulay did write that song (with Mike d'Abo), though, so there is that.

Kurt does not own a mansion or a yacht. He lives in a middle-class neighborhood in an ordinary house, which if you had any inclination to find, could be found easily through public records. As for "Build Me Up Buttercup," I've reviewed the sales records for that song because it's included in the EMI suit. SC has had valid licensing, for which it has paid the applicable royalties in full, for the song.

I have no idea where you're getting your (dis)information, but you're being misled by your source.

Here's the thing, Joe...the only way a host has more than a nominal cost to fight SC is if he or she can't show 1:1 correspondence. It just does not cost that much money--the cost of the audit, which we often waive, and the time required to gather the materials. It's not zero, of course, but it's far, far less than the cost of a settlement.

I think you'll agree that someone who can't show 1:1 correspondence is, by definition, a pirate.

The dispute between EMI and SC is almost entirely a disagreement about the scope and interpretation of the MCPS license. (Virtually none of the other materials EMI sued on had been sold in the three years prior to the suit.) It's not a binary situation.

It doesn't matter which song you insert. The answer is the same. What you don't seem to understand is that a license was issued and the royalty was paid. The only question is whether SC's actions exceeded the scope of that license. This is a commercial dispute. It's not about "stealing."

I fail to see what the age of the songwriters has to do with it. Is it "stealing" if the songwriter is 70 but not stealing if the songwriter is 69?

You're a lawyer right? How do you convince a Jury to side with you? By playing on there heart strings? Make the defendant look like they did it to their own parents or grandparents right? Just a little bit of your own tricks.

Did the SC employee not file a written affidavit stating that SC produced most of their songs without permission? As far as stating that "Derek Slep" said it was cheaper to get caught and pay the settlement fees rather than pay up front? Is this not accurate or true?

It used to be that if anyone said anything at all against what SC claimed, there were 50 people lined up to call you stupid or a Pirate, where are all the cheerleaders now? Athena Thunder Insane etc???? Cat got your tongue now that things aren't so peachy with your savior(SC)?

I hope you are not naive enough to believe what what is in an affidavit is the Gospel truth. Especially from someone who has an axe to grind. What evidence did the Testator bring with him or her?

Mostly I just present the facts. When I "prep" witnesses to testify, I simply ask them to tell the truth in their own words--and you can ask any of the dozens of witnesses I've spoken to over the years, and every last one of them will tell you that I instructed them to tell the truth, no matter what.

Jurors aren't stupid, and if you treat them as though they are, they tend to resent it.

There is such an affidavit, and it was given by a disgruntled former employee. Knowing Derek, I can tell you that it would be entirely within his character to make a statement, in a moment of frustration, along the lines of, "I don't know why we pay all these royalties. It would be cheaper not to pay them and just settle later." Have you ever been faced with doing something that was uncomfortable and frustrating, but was the right thing to do? Have you ever allowed yourself to think about what it would be like to shirk your responsibilities?

I will admit that on more than one occasion I've said something like, "I should just tell Judge So-and-So to f--- himself." Does that mean I was actually planning to do that, or would ever do that? Does it mean that I don't respect judges? Of course not.

The problem with the affidavit is that it doesn't comport with the actual record. I can't speak for what other companies do, although I suspect that many karaoke companies have a poor record of compliance with licensing and royalties. But I know that SC has a long history of substantial compliance. Your allegations are off-base and driven by ignorance and hatred. I don't know what is driving your hatred--maybe you were a defendant?--but it's making you do ugly things that reflect poorly on you.

Not that I am picking on religion, since I am a Christian, but I am a realist and understand that the Bible is a guide to be a better person and written a long time ago when people thought that "thunder" was God being angry for something we have done.

So who exactly tells juries what to do? Do Men in Black go into the Deliberation Room and tell them how to vote and if they don't they eliminate them. Sorry, you have no idea of what you are talking about. Sure there may have been some bad juries, but they are picked at random and in most cases agreed to by both the Prosecutor and Defence, remember that both sides have only a number of rejections. They may not be perfect but they certainly are not all corrupt as you try to betray them as being. And don't bring up OJ because that was nothing but a circus and had no semblence of what goes on in the majority of trials.

The thing that makes your statements "seem utterly unsubstantiated and completely false" is that they are actually unsubstantiated and completely false. I have no idea if you made those statements up yourself or are just repeating something you've heard, but it really doesn't matter.

I haven't attacked anyone, least of all you. I can understand that you might feel attacked because I have responded to your false statements, but I can't help how you feel.

:lol: :lol: I have said almost exactly the same thing when people yammer on about "government controlled media", etc. I have worked in the media for over 30 years, Radio & TV. Never, EVER did anyone from the "gubmint" come into the newsrooms and tell people what to say (or not say). People making such claims have never worked in such an environment themselves, be it a jury room or a newsroom.
