"some material way" is an overly broad scope but probably includes dying... But when it comes to outright dying, you've only got 2 choices:

Solution #1: Don't die if you can avoid it.

Solution #2: Don't lease it if you can't.

Which brings up the dying question. Would I have to let everyone in my life know about the GEMS? Say I did inform my wife on what to do with the discs but we were both killed in a car crash. The kids or whomever is on charge of our estate mistakenly include the GEM discs in with all the cds dvds software discs donated to the Goodwill. You going to go after and sue the people that didn't know any better and have the discs away?

Probably.... they skin kittens and eat them raw you know...

But you won't care.... you'll be dead anyway.

Well that might be a good lead in for questions about the advanced series....

How long does $30 pay for on these tracks? Forever? A year? In 2, 3 or 5 years time will we have to pay for them again because your revenue chain on them ran out? What exactly is "ours" and "yours"? What if you decided to pull tracks, will those people who bought them still have access to them or will they be gone forever?

So many questions about this stuff, now that I'm reading and watching stuff on the net.

We would probably do what we do in pretty much every situation involving the GEM series, short of outright piracy, where there is a problem: We talk to the people involved and work out a reasonable resolution. We would certainly work with whoever is handling your affairs to get the set transferred for money (which your estate would receive all of). If somebody made a mistake and donated the discs to Goodwill, we'd work it out.

If you're concerned about this, let me offer a suggestion, or make a request: Please put a note with your GEM discs that says, "In the event of my demise, please call Phoenix Entertainment Partners, 800-788-4487, about what to do with these discs." We will help your heirs dispose of the discs by finding someone to take over the licenses, or if they want to continue the business, get the licenses transferred into their name. You don't have to do this if you don't want to, but if it concerns you, this is probably the best way we can help. Above all, I promise that we will be reasonable, no matter what happens.

If you've been "dealing with the GEMS" for 5 years and your investment hasn't paid for itself. The problem is not with the GEMS (6000 un-duplicated tracks at .75 cents per).

I paid off that investment within 6 months of the initial outlay. 5 years later, pure profit.
